Disclosure of Records Without Consent
FERPA provides many specific exceptions when the University can disclose education records without specific student consent. They include but are not limited to:
- Disclosure to school officials within Clemson University or other outside parties to whom the institution has outsourced institutional services or functions whom Clemson has determined to have legitimate educational interests
- Disclosure to officials of another school where student seeks to enroll
- Disclosure in connection with financial aid for which the student has applied
- Disclosure to accrediting organizations to carry out their accrediting function
- Disclosure to parents of a dependent student, as defined by the IRS Code
- Disclosure to comply with a judicial order or lawfully issued subpoena
- Disclosure in connection with a health or safety emergency
- Disclosure to military recruiters
Disclosure of Records Without Consent--Health and Safety Exception
A higher education institution may disclose personally identifiable information from education records to appropriate parties, including parents, in connection with an emergency if knowledge of the information is necessary to protect the health or safety of the student or other individuals.
When these circumstances arise, the school official making the disclosure should keep a record of:
- The articulable and significant threat that formed the bases for the disclosure
- The parties to whom the information was disclosed; and
- The information that was disclosed
